These Terms and Conditions (“Terms”) govern your use of the website armor.fkumuhs.ac.id (the “Site”), operated by armor.fkumuhs.ac.id (“Company,” “we,” “us,” or “our”). By accessing or using the Site, you (“User,” “you,” or “your”) agree to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. c. Attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site, by hacking, password “mining,” or any other illegitimate means.
d. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Site or any part thereof.
e. Use the Site to upload, post, email, transmit, or otherwise make available any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, or otherwise violates any law or right of any third party.
f. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
g. Sublicense, resell, rent, lease, transfer, assign, or otherwise commercially exploit the Site to any third party.
h. Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
i. Probe, scan, or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site.
j. Reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes any portion of the Site, use of the Site, or access to the Site without express written permission from us.

2.3. Availability: We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users.

3. User Accounts

3.1. Account Creation: Some features of the Site may require you to register for an account. When you create an account, you agree to provide accurate, complete, and current information as requested during the registration process. You are solely responsible for maintaining the confidentiality of your account login information (username and password) and for all activities that occur under your account.

3.2. Account Security: You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this Section 3.2. You may be held liable for losses incurred by the Company or any other user of or visitor to the Site due to someone else using your username, password, or account as a result of your failing to keep your account information secure and confidential.

3.3. Account Termination/Suspension: We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion, particularly if we believe that your conduct violates these Terms, is harmful to other users, third parties, or the Company, or for any other reason, including inactivity.

4. Intellectual Property Rights

4.1. Ownership: The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by the Company, its licensors, or other providers of such material and are protected by Indonesian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2. Trademarks: The Company name, the terms “armor.fkumuhs.ac.id,” the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

4.3. Limited License to Users: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view the Site content solely for your personal, non-commercial use. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on this Site is strictly prohibited. You must not delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Site.

5. User Content

5.1. Definition: “User Content” refers to any content, materials, information, data, photos, text, graphics, videos, messages, or other items that you upload, post, submit, or otherwise make available on or through the Site, including but not limited to comments, reviews, forum posts, project descriptions, or uploaded images of home exterior projects.

5.2. Your Responsibility for User Content: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:
a. You own or have the necessary licenses, rights, consents, and permissions to use and authorize the Company to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content to enable inclusion and use of the User Content in the manner contemplated by the Site and these Terms.
b. Your User Content does not infringe upon, misappropriate, or violate any third party’s intellectual property rights, privacy rights, publicity rights, or any other rights.
c. Your User Content does not violate any law, including but not limited to laws regarding defamation, privacy, obscenity, or consumer protection.
d. Your User Content is not malicious, fraudulent, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

5.3. License Grant to Company: By submitting User Content to the Site, you hereby grant the Company a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicenseable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Site and the Company’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels. This includes, but is not limited to, displaying your submitted photos of home exterior projects on our Site, social media, or marketing materials, with appropriate attribution where feasible.

5.4. Content Standards: You agree not to upload, post, or transmit any User Content that:
a. Contains copyrighted materials without permission of the copyright owner.
b. Contains unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
c. Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
d. Misrepresents your identity or affiliation with any person or entity.
e. Advocates illegal activity or discusses an intent to commit an illegal act.
f. Is obscene, vulgar, or contains sexually-oriented images or descriptions.
g. Threatens or abuses others.
h. Is subject to confidentiality obligations.

5.5. Monitoring and Removal of User Content: We do not pre-screen User Content, but we reserve the right (but not the obligation) to monitor, review, edit, or remove any User Content, in whole or in part, that we deem in our sole discretion to violate these Terms or otherwise be objectionable, without prior notice. We may also disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy, or if required by law enforcement or government agency.

6. Disclaimer of Warranties

6.1. “As Is” and “As Available”: YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

6.2. Accuracy of Information (Home Exterior Niche Specific): THE COMPANY DOES NOT WARRANT THAT THE SITE’S CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. THE INFORMATION, ADVICE, DESIGNS, PRODUCT RECOMMENDATIONS, AND ALL OTHER MATERIALS PRESENTED ON THE SITE, INCLUDING THOSE RELATED TO HOME EXTERIOR IMPROVEMENTS, ARE PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY AND ARE NOT INTENDED TO CONSTITUTE PROFESSIONAL ADVICE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF THIS INFORMATION. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS STRICTLY AT YOUR OWN RISK. NOR DOES IT WARRANT THAT DEFECTS WILL BE CORRECTED. WE DO NOT GUARANTEE THAT THE SITE WILL BE OPERATIONAL AT ALL TIMES, OR THAT ITS CONTENTS WILL BE UNBLEMISHED BY TECHNICAL OR TYPOGRAPHICAL ERRORS.

6.4. 7. Limitation of Liability

7.1. Exclusion of Damages: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

7.2. Monetary Cap: IN NO EVENT SHALL THE COMPANY’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SITE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (US$100.00) (WHICHEVER IS LESS).

7.3. Exclusions and Limitations: SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OF WARRANTIES OR LIMITATIONS OF LIABILITY.
